How to include a Gift in your Will
Step 1. Think about the size and type of gift you wish to give.
Most of our supporters choose to leave a residual legacy. These gifts hold their value regardless of inflation and allow you to cover loved ones' needs first.
Step 2. Speak to your solicitor or financial advisor.
Ask them to include your chosen gift to Stroke Foundation when you write or update your Will.
Suggested wording for your Will
Option 1: Whole of estate
If you wish to leave the whole of your estate, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes the whole of my estate to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
Option 2: Percentage of estate
If you wish to leave a percentage of your estate, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes [insert number] % of my estate to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
Option 3: Residual legacy
A residual legacy is what is left of your estate after all of your wishes have been carried out and expenses in finalising your estate have been met. It is a popular choice for many of our supporters as it allows you to first leave gifts to your loved ones and pay any financial commitments. It also automatically adjusts to changes in the value of your Estate.
If you wish to leave a residual legacy, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes the residue of my estate to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
Option 4: Percentage of residual legacy
If you wish to leave a percentage of residual legacy, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes [insert number] % of the residue of my estate. to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
Option 5: Pecuniary legacy
This type of gift ensures that the Stroke Foundation receives a specific cash amount. Your solicitor can advise you of ways to ensure the gift retains its relative value (for example, by increasing the amount by reference to CPI).
If you wish to leave a specific cash amount, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes the sum of $ [insert value of your gift] to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
Option 6: Specific legacy
If you wish to leave a specific item such as shares or property, ask your solicitor to insert the following clause into your Will:
I give free of all duties or taxes [insert number] of my [insert name of shares] shares to the Stroke Foundation (ABN 42 006 173 379) for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.
